The subject was annexed in 2011. It was developed in Gwinnett County with buffers and fencing along north and west property lines as required by 1994 zoning conditions.
The applicant’s letter of intent proposed auto or truck accessory installation uses such as window tinting and stereo installations; however the SUP for this zoning category could provide for additional maintenance and service related activities that the building is not currently equipped for.
ANALYSIS OF REZONING REQUEST
Due to the change in use and access point proposed, the adjacent residential property to the south warrants consideration of an appropriate buffer and screening. The buffer between commercial and multi-family residential districts is typically 20’ (to address visual and auditory screening), and the planted landscape strip standard is 10’. The existing strip is estimated at 5’ based on graphics provided. Planning Commission added that City Council could approve an alternative buffer or screen upon design review by Director of Planning & Economic Development Department.
The Planning Commission recommends approval with the following conditions:
Service Center limited to 11,000 square feet within the existing building fronting the south side of the existing building as delineated on the “Auto Service Layout” exhibit provided by the applicant.
No body or paint repair. Service limited to auto and truck maintenance and accessory installations.
Service permitted only in enclosed bays (4 shown).
Service bays shall be oriented so as to parallel Pleasant Hill Road.
Service bays shall be screened from adjacent residential property (Avery Park Townhomes) to the south. One row of parking (approximately 19 spaces) closest to Snipes Court/Labrador Way shall be removed and replaced with a vegetated screen to include 2 rows of evergreen trees or shrubs, staggered 10’ on center with minimum 3’ height at time of planting and maintained in perpetuity. Curb and gutter shall be removed and replaced.
Each tenant space shall comply with Gwinnett County sewer code. As may be required by Lilburn Development Regulations and Gwinnett County Sanitary Sewer Code, building shall be renovated with floor drains to accommodate an approved oil/grit separator.in accordance with Gwinnett County sanitary sewer code
No washing of parts or vehicles outside the building.
No Auto/Truck Body and Heavy Repair services, as described in Article 6.
No Heavy Equipment Service, as described in Article 6.
No outside storage or outdoor displays.
No used tire sales or used auto parts sales.
No vehicle sales.
Parking of all vehicles shall be in designated spaces, in compliance with Article 8, and not to exceed maximum off-street parking spaces allocated for auto service center (1/200 s.f.).
Plans illustrating compliance with vegetated screening requirements, fire wall separation, sewer code compliance and other applicable requirements shall be submitted for approval prior to permitting for construction or application for certificate of occupancy.
In addition, a graphic illustrating an alternative screen to that which staff is proposing in condition #5 is to be provided by the applicant to the Director of Planning & Economic Development Department for City Council meeting.
