Preparing for Court
Dress Code for Court
No tank / halter tops, muscle shirts, shorts, ragged clothing, hats, or sunglasses will be allowed.

Court Procedures
If you choose to appear in court or have a case that requires a mandatory court appearance, bring your citation and check in 15 minutes before court begins. Court begins on the first and second Tuesdays of the month at 9 a.m., and on the third and fourth Tuesdays of the month at 3:30 p.m. You will need to complete and turn in the following forms, which will be available in the lobby:
  • The Waiver of Rights form is for basic traffic and city ordinance citations. The form is provided in English and Spanish.
  • The Waiver of Rights for Driving Under the Influence (DUI) form is to be used only if you were charged with driving under the influence. The form is provided in English and Spanish.
  • The Request for Pretrial Conference with Solicitor and Waiver of Right to Counsel form is to be signed also, if you wish to discuss your case with the solicitor to negotiate a disposition if you do not have legal representation.

After completing the forms, proceed to the check-in table where the forms and your copy of citation(s) are presented to the clerks to attach to your court paperwork. Take a seat in the courtroom. The solicitor will call you by the type of charge, not by appearance or alphabetical order.

After your case has been heard you must return to the check-in table to pay your fine or complete any additional paperwork from the disposition of your case.

Pleading Not Guilty
When you check in, please note on your waiver form that you are pleading not guilty. If you have decided to plead not guilty, you have the option of having a bench trial (judge only) or a jury trial. A bench trial will be held at Lilburn Municipal Court and will be reset for another court date. If you would prefer to have a Jury Trial, you will be required to complete a Request for Jury Trial form and the case (and any bond posted) will be transferred to Gwinnett County State Court, which will notify you of your new court date.
