Public Hearing Item No. 1 - Zoning Action - Special Use Permit – Bulk Container Storage

Applicant, Souter Holdings LLC., is requesting a Special Use Permit to allow for bulk container storage on the property located at 4295 Lilburn Industrial Way, R6133 066. The subject property is comprised of 2.96+/- acres. The lot is zoned IA, Industrial Activity. 


Based on the criteria for granting a Special Use Permit found in Article 10, Section 1003 of the Lilburn Zoning Ordinance, staff feels that the applicant’s request meets the criteria of Articles 6, and 10 of the Zoning Ordinance for the proposed use and for the granting of a Special Use Permit.


Staff is recommending approval with conditions, including a sunset provision timeline of 5 years with the opportunity for the applicant to reapply to continue the SUP.

Public Hearing Item No. 2 - Zoning Ordinance Text Amendments – Multiple edits to Article 6 and 14

Text amendments are proposed to Appendix A, Article 6, and Article 14, to amend permissions for multiple use types, to add use types to provide consistency with Business Licensing regulations,processes, and to add definitions, where necessary, for new use types proposed.


These amendments are proposed to clean up references between Ordinances, add new use types Business Services frequently receives Occupational Tax Certificate Applications for. For a full list of uses amended or added, please refer to the Staff Analysis’ General Application Section.

Agenda Item No. 1: Approval of Contract No. 75-2025, a contract with Playground Creations Company for the enhancement of Lilburn City Park playground in the amount and not to exceed $322,517.00. Further, granting the City Manager authority to sign the contract. The funding source is 2023 SPLOST.

The Public Works Department is planning a winter playground enhancement which consists of an expansion of our playground area to include installation of a new play surface area with musical instruments and play space, and drainage addition under the new play space. Also, staff will be replacing one old play unit with a new one that will add to our accessibility for handicap visiting children. Removal of areas for old curbing and installation of new curbing will take place that allows for greater and smoother access to the musical instruments area. Staff also plans to add a “communication board” which is designed to encourage learning with play experience. This board will contain both English and Spanish. Lastly, staff plans a full turf replacement with this project.

Agenda Item No. 2: Approval of Resolution No. 2025-12, a Resolution authorizing an amendment to the City of Lilburn’s Georgia Fund 1 account.

The City of Lilburn moved from PNC to Truist as our primary bank for city bank accounts, including the General Fund. The City’s savings are invested in Georgia Fund 1, which has a current balance of $5,098,095.11 and a current yield of 4.01676%. The FY24-25 budget included revenue from interest in Georgia Fund 1 in the adopted budget. From July 1, 2024, through June 30, 2025, the interest earned from the City’s savings in Georgia Fund 1 was $231,611.10. 

To move this amount from Georgia Fund 1 to the General Fund, we must change the bank account for the General Fund from the old PNC bank account to the new Truist bank account. A Resolution of the Mayor and Council is required to amend an existing Georgia Fund 1 account.

Agenda Item No. 3: Approval of Ordinance 2025-654, an Ordinance to amend certain subsections of Chapter 46 – Parks and Recreation Sections 46-1, 46-2, 46-3, 46-4, and 46-57.

Amended sections provide for designating City Hall as a park to allow for establishment and ability to enforce hours of operation and to restrict access when the facility is closed.

Agenda Item No. 4: Approval of Ordinance No. 2025-658, an ordinance to amend the FY24-25 budget by increasing General Fund revenue by $479,850 and reconciling expenditures across 6 departments and increasing ARPA Fund by $68,320 and reconciling expenditure across 5 departments. The General Fund adjustments are due to GASB 87 which require capital leases to be expended upon contract execution for the full 5-year value of the lease. ARPA adjustments are reflective of reimbursements received and expended.

Since the adoption of the amended FY2024/2025 budget in June 2025 (Ordinance No. 2025-652), changes to revenues and appropriations in the General Fund are required to reflect conformity with Audit Rule GASB 87.  The ARPA Fund changes to revenues and appropriations reflect reimbursements that should be reflected in the FY 2024/2025 Budget. The amended budget for FY 24-25 General Fund Budget will result in revenue and expenditures totaling $14,246,082; the amended budget for FY 24-25 ARPA Fund Budget will result in revenue and expenditures totaling $824,180.

Agenda Item No. 5: Approval of Resolution No. 2025-14, a Resolution authorizing an advance of $2,690,000 including a loan in the amount of $966,232 to the Lilburn Downtown Development Authority for site development of the assemblage at First and Main.

The Downtown Development Authority released an Invitation to Bid No. 2024-01 on November 8, 2024, for site development services for the assemblage at First and Main in Old Town. The bid opening was scheduled for December 11, 2024, with a mandatory pre-bid conference on November 18, 2024. No bidders participated in the mandatory pre-bid conference, and the DDA placed the bid on hold until the land development permit for the assemblage was approved by the County and the City. 

Invitation to Bid No. 2025-01 opened on June 3, 2025, with a mandatory pre-bid conference held on June 18, 2025. Three contractors participated in the pre-bid conference. The bids were due August 27, 2025, at 2:15 pm, and one bid was received from Lewis Contracting Services, LLC, in the amount of $2,690,000.00. The DDA’s project manager and engineer met with the bidder for a best and final offer. 

The City must advance funds to the DDA to fund the contract. The advance funds will come from a variety of funding sources, and most of the advance funds ($1,723,768) will not be repaid to the City by the DDA as the improvements will be public. However, a loan in the amount of $966,232 will be repaid to the City when the property sells.

The City must advance funds to the DDA to fund the contract for the site development of the assemblage at First and Main with Lewis Contracting Services, LLC. The advance funds will come from a variety of funding sources, and most of the advance funds ($1,723,768) will not be repaid to the City by the DDA as the improvements will be public. However, a loan in the amount of $966,232 will be repaid to the City when the property sells.

The Intergovernmental Agreement outlines the terms and conditions of the loan and its repayment.
