Lilburn Comprehensive Plan 2019-2023

Every 5 years municipalities are required to update their Comprehensive Plan. Working with the Atlanta Regional Commission, Lilburn Steering Committee and staff compiled the document to satisfy the minimum requirements to maintain the City’s Qualified Local Government status as determined by the Department of Community Affairs. 

DCA approved the draft document without any necessary revisions, public comments were received through October 31, 2018, and minor revisions were incorporated for City Council adoption prior to the February, 2019 DCA deadline.

Stream Buffer Ordinance Text Amendments and Adoption Of “Lilburn Riparian Buffer Restoration Guidelines”

The Lilburn City Code, SubPart A, General Ordinances, Chapter 109, Article VII, Stream Buffer Protection was last amended in 2005.  Some of the applicable definitions, land development requirements, exemptions, variances, appeals, and enforcement procedures are updated to comply with State laws and reflect the City’s standard procedures in administration of the code.  

Also, the 2005 Ordinance does not address mitigation or provide standards for revegetation in areas of impact due to violations.  To provide flexibility in addressing encroachments and mitigation for variances or violations, planning staff developed the Lilburn Riparian Buffer Restoration Guidelines (Guidelines) based on common practices in the Metro North GA Water Planning District, but which is unique to Lilburn.

Staff recommends adoption of text amendments into the Stream Buffer Protection Ordinance, and adoption of the Guidelines as may be revised or amended from time to time.

Floodplain Management/Flood Damage Prevention Ordinance Repeal and Replace

The Lilburn City Code, SubPart A, General Ordinances, Chapter 109, Article III, Floodplain Management and Flood Damage Prevention was last amended in 2007.  Meanwhile the Metro North GA Water Planning District (MNGWPD) adopted a “District Model Floodplain Management/Flood Damage Prevention Ordinance” in 2013 and Gwinnett County updated their Floodplain Management Chapter 700 of UDO in April, 2015 as an acceptable equivalent to the Model Ordinance. 

While City has the option to adopt either, in keeping with the City’s IGA with Gwinnett County, and to maintain consistency in the administration of regulations related to floodplain areas, staff recommends adopting text amendments to provide the “acceptable equivalent”. 

Since there were significant changes in the organization of the document (which result in text amendments to every page), staff further recommends a repeal and replacement of all applicable Divisions of the existing ordinance.
