Agenda Item 1 - Resolution # 2020-07, extension of moratorium barring the acceptance of applications for townhome developments in the City of Lilburn

Resolution extends the moratorium placed on the acceptance of applications for the construction of new townhome developments by 120 days. On January 13, 2020, City Council adopted Resolution No. 2020-03, placing a moratorium on the acceptance of applications for the construction of new townhome developments until April 12, 2020. Additional time is needed for staff to consult with zoning and legal experts on solutions including a text amendment to the zoning code. This process requires proper legal procedure including advertisement, public hearings, and review by the Planning Commission. If approved, the moratorium will remain in place until August 10, 2020.

Agenda Item 2 - New Location for an Alcohol License – Brick Oven Pizza Bar – 411 Beaver Ruin Rd - Beer & Wine

The Licensing & Revenue Manager received a new alcohol application for consumption on premise for beer & wine from Brick Oven Pizza Bar, located at 411 Beaver Ruin Rd. The location meets all zoning requirements.  

The location previously held an alcohol license under a different business. Our ordinance requires Council approval on applications where the location hasn’t been operating continuously during the last 12 months.

Sec. 6-62(j) “Notwithstanding any other provisions of this section, any application to sell any alcoholic beverages other than distilled spirits for a location that has not been previously approved or which has not been continuously operated during the last 12 months shall be considered by the mayor and city council.

Staff recommends the license be effective immediately upon approval of the city council and contingent upon receiving an occupational tax certificate.

The location meets all zoning requirements.  This location hasn’t been approved for an alcohol license prior to this application.
